In 2018, the Georgia Adoption Code was revised to make stepparent adoptions in Georgia more streamlined. The specific requirements for stepparent adoptions in Georgia are found in O.C.G.A. § 19-8-6. The stepparent adoption will be filed in the Superior Court where the child and parent reside. If the child’s other parent consents, he or she will execute a Surrender of Parental Rights and an Acknowledgement of Surrender of Parental Rights.
Under the new adoption law, the surrender of parental rights can only be revoked within a four-day window, whereas it used to be a ten-day window. If that parent does not consent to the adoption, there are still ways to finalize the adoption. For instance, if the parent has failed to create a meaningful relationship with the child or failed to support the child financially for a period of time, his or her parental rights can be terminated by the Court for the purpose of adoption. Sometimes, the other parent is unknown or cannot be found. Georgia adoption law provides for a streamlined process to deal with those issues as well.
